These Terms of Service form a binding agreement between you and LDG Global Pty Ltd, trading as Novaa Gear. They apply
alongside our Privacy Policy, Shipping Policy, Return & Refund Policy, and Care & Warranty Card. By using our website or
placing an order, you accept these terms.

1. About these terms
These Terms of Service (Terms) govern your use of our website at novaagear.com and any orders
you place with us. "We", "us" and "our" mean LDG Global Pty Ltd (ABN 99 644 152 769, ACN 644
152 769), trading as Novaa Gear. "You" and "your" mean the person visiting our website or placing
an order.
By browsing our website, placing an order or otherwise interacting with us, you confirm you have
read, understood and accept these Terms. If you do not accept them, please do not use our website
or place an order.
2. Eligibility
You must be at least 18 years old and legally able to enter into a binding contract to place an order.
By placing an order, you confirm that you meet these requirements.
3. Orders and contract formation
Placing an order through our website is an offer by you to buy the products in your cart on these
Terms. A binding contract is formed only when we accept your order, which we do by sending you an
order confirmation email or by dispatching the products to you — whichever happens first.
We reserve the right to refuse or cancel any order — for example, where stock is unexpectedly
unavailable, where there has been an error in pricing or product information, or where we suspect
fraud. If we cancel an order after you have paid, we will refund the full amount paid.
4. Pricing and payment
• All prices on our website are shown in Australian dollars (AUD) and include GST.
• Shipping charges are additional, calculated at checkout or quoted separately for regional and
remote destinations. See our Shipping Policy for detail.
• We accept payment by the methods shown at checkout, including major debit and credit cards,
Afterpay (subject to Afterpay's own terms), and direct bank transfer.
• Tax invoices are issued on request. To request a tax invoice, email support@novaagear.com
with your order number.
• We may change prices at any time without notice. Price changes do not affect orders already
confirmed.
5. Product information and fitment
We take care to describe our products accurately, including specifications, weights, ratings and
vehicle fitment guidance. However:
• Photographs and illustrations are for representation only. Minor variations in finish or hardware
may occur between production runs.

• Vehicle fitment information is provided as a guide based on the vehicle make, model and year.
Factory variations, aftermarket modifications, and other vehicle changes may affect fitment. If you
are unsure, request a fitment check by emailing photos and measurements to
support@novaagear.com before ordering.
• Load ratings, tow ratings and compliance information are based on the product as supplied. It is
your responsibility to operate the product within those ratings and within your vehicle's
manufacturer-specified limits.
6. Cancellation, returns and warranty
Cancellations, returns and refunds are handled under our Return & Refund Policy. Warranty claims
are handled under the terms of the Care & Warranty Card supplied with your product. Both policies
operate alongside your rights under the Australian Consumer Law (see Section 11).
7. Shipping and delivery
Shipping arrangements, costs and delivery times are set out in our Shipping Policy. Title to and risk in
the products passes to you on delivery to the address you provided.
8. Intellectual property
All content on our website — including text, photographs, logos, branding, product designs,
illustrations and videos — is owned by us or licensed to us, and is protected by Australian and
international intellectual property laws. You may not copy, reproduce, distribute, modify, or use any of
this content for commercial purposes without our prior written permission.
You may share links to our website and content on social media for personal, non-commercial
purposes, with appropriate attribution.
9. Acceptable use of the website
You agree not to:
• Use the website for any unlawful purpose or in any way that breaches these Terms.
• Attempt to interfere with, disrupt, or gain unauthorised access to our website, servers, or networks.
• Submit false, misleading, or fraudulent information.
• Use automated systems (bots, scrapers) to access the website without our prior written
permission.
• Misrepresent your identity or impersonate another person.
10. Limitation of liability
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that
you have under the Australian Consumer Law or any other law where it cannot lawfully be excluded.

To the maximum extent permitted by law, and subject to the paragraph above:
• Our total liability to you in connection with any product or order is limited, at our option, to repairing
the product, replacing the product, supplying an equivalent product, or refunding the price you paid
for the product.
• We are not liable for indirect, consequential, incidental or special losses, including loss of profit,
loss of use, loss of opportunity, loss of data, or damage to other property, however caused.
• We are not responsible for any damage, loss, fine or liability arising from your failure to operate the
product within its stated ratings, your failure to comply with vehicle manufacturer specifications, or
your failure to comply with road law in the jurisdiction you are driving in.
11. Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You
are entitled to a replacement or refund for a major failure and compensation for any other reasonably
foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods
fail to be of acceptable quality and the failure does not amount to a major failure.
12. Indemnity
You agree to indemnify us against any loss, damage, claim or expense (including reasonable legal
fees) we incur as a direct result of your breach of these Terms, your misuse of a Novaa Gear product
outside its stated ratings or design purpose, or your breach of any law in connection with the product.
13. Force majeure
We are not liable for any failure or delay in performing our obligations caused by events outside our
reasonable control — including but not limited to fire, flood, storm, pandemic, industrial action,
transport disruption, supplier failure, or acts of government.
14. Governing law and jurisdiction
These Terms are governed by the laws of Western Australia and the Commonwealth of Australia.
You and we submit to the non-exclusive jurisdiction of the courts of Western Australia for any dispute
arising in connection with these Terms.
15. Dispute resolution
Before starting court or tribunal proceedings, both you and we agree to attempt to resolve any dispute
by direct discussion. Please email support@novaagear.com with a description of the issue and
what you are seeking. We will respond within a reasonable period and work with you in good faith to
resolve it.
16. Changes to these Terms

We may update these Terms from time to time. The current version is always published at
novaagear.com. The version that applies to a given order is the version in force when the order was
placed.
